The Constitutional Court avoided to explain the faith of the Zambaccian Dossier and asked the Supreme Court to handle the case.

The results of the enquiry will be decided on September 7, at the High Court of Cassation. According to the constitution, no enquiry of a minister can be initiated before some special procedures.

The Penal Procedure Code states that a procedural act is rendered void only when the defendant was harmed and the only way to take it back is to make the document null.

Nastase's lawyers say that when the DNA prosecutors put him to charge without the special agreement stated in the Constitution, they took the "constitutional guarantee" from him.
