Mircea Marian: "PNL and PSD are preparing, in the name of democracy, to throw the prosecutors of DNA in the hands of one of the most dubious and corruptible institutions in Romania: the Superior Council of Magistrates."
This would mean, actually, the end of the investigations which cover the senior Romanian officials and the return to the era of sad reminder in which the National Anti-corruption Prosecutor's Office was led by Ioan Amarie. CSM, which has made an international reputation from the fact that it protects the corrupt judges and prosecutors should take care of uncomfortable people as Daniel Morar and his deputy will disappear from the DNA. Politicians who want to escape the current rulers of the anti-corruption prosecutors would remain with their hands clean.
In theory, liberals and social-democracy are struggling for a generous idea: they want to depoliticize the anti-corruption fight, to take the the proposal attribution of the chief of DNA from the minister of justice - which is appointed by the parties - and to give it to the magistrates. The problem is: how much confidence can we have in CSM? In my opinion, this institution has come to be for magistrates, what became of the parliament in the cases of Nastase and Mitrea: a shelter for a particular category of citizens who, through various forms of immunity, can be above the law. The European Commission shows that "ethical standards" of the magistrates is a cause for concern: disciplinary sanctions imposed by the CSM are "minor".
Why should the attribution of the Chief Prosecutor's of DNA proposal to remain in the hands of a politician like the minister of justice? Because it responds, even indirectly, in front of the electorate, which is not the magistrates case - a relatively closed caste, where the criteria for selection and promotion are extremely questionable. The Minister of Justice, Catalin Predoiu, seems to be a proffered alternative to those of CSM, especially if we look at the fact that this institution is currently led by Lidia Bărbulescu, the creation of the former minister Rodica Stănoiu. The career Ms. Bărbulescu is an accurate picture of what happens in the body of the Romanian magistrates.
Look at the pain which is felt by Catalin Predoiu: the man simply dies of fear before taking a decision. The party presses him to remove Morar baits him with a parliamentary post, if he fulfills his mission of executor. On the other hand are those from Brussels, which are keeping in the current chief on DNA in their arms, and a part of the public opinion, it would accuse Predoiu of burring the fight with corruption. The man wants to leave the ministry without angering anyone - which means not to do anything,an he has achieved this so far. Accordingly, minister Predoiu decided to pass the problem of Morar either to CSM or to the general prosecutor.
Nothing can keep him Predoiu to be a coward and not to propose anyone for the leadership of DNA. For six months, the institution could be led by delegation. The message sent to the anti-corruption prosecutors is: behave, do not bother our election campaign with your investigations, we will see who will be in power in 2009, after which your turn will come.
