Criminals will be able to negotiate their fate

The government has initiated the future Code for Penal Procedure.

According to a decision made yesterday, the new Code will introduce in the Romanian system a rule which will allow the defendant to negotiate the case with the prosecutor. So, if the defendant confesses of having committed the crimes and accepts to plea as guilty, he will be able to sign an agreement with the prosecutor, in the presence of his lawyer.

This act will allow him to get a lighter punishment at the end of the trial, after the judge checks the evidence for the confession made in front of the prosecutors.

Also, this new Code will create a new institution called “freedom judge”. Each court will have magistrates who will judge only the cases regarding the applying of some measurements which restrain some rights of the persons in question. The freedom judge will emit warrants for arrests, will approve house searching and phone tapping.
