Nastase could escape the charges

The Constitutional Court decided that the law used to indict the ex premier is breaking the fundamental law.

The prosecutors have inquired the ex premier in the file Zambaccian using a law in the ministry responsibility which was declared unconstitutional yesterday.

It is about a law article adopted by the parliament in 2005 stating that the ex government members can face penal charges like every other citizen, unlike ministers in function , who benefit from a special regime and cannot be prosecuted unless the Deputy Chamber, the Senate or the presidency demands it.

The lawyers of Adrian Nastase said that the discrimination between the actual and former ministers is a Constitution breaking. The decision of the Court puts at risk the entire work done by the DNA prosecutors.
